  9. LICENSE
  10. -------
  11. THE WORK (AS DEFINED BELOW) IS PROVIDED UNDER THE TERMS OF THIS
  12. CREATIVE COMMONS PUBLIC LICENSE ("CCPL" OR "LICENSE"). THE WORK IS
  13. PROTECTED BY COPYRIGHT AND/OR OTHER APPLICABLE LAW. ANY USE OF THE
  14. WORK OTHER THAN AS AUTHORIZED UNDER THIS LICENSE OR COPYRIGHT LAW IS
  15. PROHIBITED.
  16. BY EXERCISING ANY RIGHTS TO THE WORK PROVIDED HERE, YOU ACCEPT AND
  17. AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE. TO THE EXTENT THIS
  18. LICENSE MAY BE CONSIDERED TO BE A CONTRACT, THE LICENSOR GRANTS YOU
  19. THE RIGHTS CONTAINED HERE IN CONSIDERATION OF YOUR ACCEPTANCE OF SUCH
  20. TERMS AND CONDITIONS.
  21. 1. Definitions.
  22. a. "Collective Work" means a work, such as a periodical issue,
  23. anthology or encyclopedia, in which the Work in its entirety in
  24. unmodified form, along with one or more other contributions,
  25. constituting separate and independent works in themselves, are
  26. assembled into a collective whole. A work that constitutes a
  27. Collective Work will not be considered a Derivative Work (as defined
  28. below) for the purposes of this License.
  29. b. "Creative Commons Compatible License" means a license that is
  30. listed at http://creativecommons.org/compatiblelicenses that has been
  31. approved by Creative Commons as being essentially equivalent to this
  32. License, including, at a minimum, because that license: (i) contains
  33. terms that have the same purpose, meaning and effect as the License
  34. Elements of this License; and, (ii) explicitly permits the relicensing
  35. of derivatives of works made available under that license under this
  36. License or either a Creative Commons unported license or a Creative
  37. Commons jurisdiction license with the same License Elements as this
  38. License.
  39. c. "Derivative Work" means a work based upon the Work or upon the Work
  40. and other pre-existing works, such as a translation, musical
  41. arrangement, dramatization, fictionalization, motion picture version,
  42. sound recording, art reproduction, abridgment, condensation, or any
  43. other form in which the Work may be recast, transformed, or adapted,
  44. except that a work that constitutes a Collective Work will not be
  45. considered a Derivative Work for the purpose of this License. For the
  46. avoidance of doubt, where the Work is a musical composition or sound
  47. recording, the synchronization of the Work in timed-relation with a
  48. moving image ("synching") will be considered a Derivative Work for the
  49. purpose of this License.
  50. d. "License Elements" means the following high-level license
  51. attributes as selected by Licensor and indicated in the title of this
  52. License: Attribution, ShareAlike.
  53. e. "Licensor" means the individual, individuals, entity or entities
  54. that offers the Work under the terms of this License.
  55. f. "Original Author" means the individual, individuals, entity or
  56. entities who created the Work.
  57. g. "Work" means the copyrighted voice prompt files recorded by Allison
  58. Smith for Asterisk and distributed with this License.
  59. h. "You" means an individual or entity exercising rights under this
  60. License who has not previously violated the terms of this License with
  61. respect to the Work, or who has received express permission from the
  62. Licensor to exercise rights under this License despite a previous
  63. violation.
  64. 2. Fair Use Rights.
  65. Nothing in this license is intended to reduce, limit, or restrict any
  66. rights arising from fair use, first sale or other limitations on the
  67. exclusive rights of the copyright owner under copyright law or other
  68. applicable laws.
  69. 3. License Grant.
  70. Subject to the terms and conditions of this License, Licensor hereby
  71. grants You a worldwide, royalty-free, non-exclusive, perpetual (for
  72. the duration of the applicable copyright) license to exercise the
  73. rights in the Work as stated below:
  74. a. to reproduce the Work, to incorporate the Work into one or more
  75. Collective Works, and to reproduce the Work as incorporated in the
  76. Collective Works;
  77. b. to create and reproduce Derivative Works provided that any such
  78. Derivative Work, including any translation in any medium, takes
  79. reasonable steps to clearly label, demarcate or otherwise identify
  80. that changes were made to the original Work. For example, a
  81. translation could be marked "The original work was translated from
  82. English to Spanish," or a modification could indicate "The original
  83. work has been modified.";
  84. c. to distribute copies or phonorecords of, display publicly, perform
  85. publicly, and perform publicly by means of a digital audio
  86. transmission the Work including as incorporated in Collective Works;
  87. d. to distribute copies or phonorecords of, display publicly, perform
  88. publicly, and perform publicly by means of a digital audio
  89. transmission Derivative Works.
  90. e. For the avoidance of doubt, where the Work is a musical
  91. composition:
  92. i. Performance Royalties Under Blanket Licenses. Licensor waives the
  93. exclusive right to collect, whether individually or, in the event
  94. that Licensor is a member of a performance rights society
  95. (e.g. ASCAP, BMI, SESAC), via that society, royalties for the public
  96. performance or public digital performance e.g. webcast) of the Work.
  97. ii.Mechanical Rights and Statutory Royalties. Licensor waives the
  98. exclusive right to collect, whether individually or via a music
  99. rights agency or designated agent (e.g. Harry Fox Agency), royalties
  100. for any phonorecord You create from the Work ("cover version") and
  101. distribute, subject to the compulsory license created by 17 USC
  102. Section 115 of the US Copyright Act (or the equivalent in other
  103. jurisdictions).
  104. f. Webcasting Rights and Statutory Royalties. For the avoidance of
  105. doubt, where the Work is a sound recording, Licensor waives the
  106. exclusive right to collect, whether individually or via a
  107. performance-rights society (e.g. SoundExchange), royalties for the
  108. public digital performance (e.g. webcast) of the Work, subject to the
  109. compulsory license created by 17 USC Section 114 of the US Copyright
  110. Act (or the equivalent in other jurisdictions).
  111. The above rights may be exercised in all media and formats whether now
  112. known or hereafter devised. The above rights include the right to make
  113. such modifications as are technically necessary to exercise the rights
  114. in other media and formats. All rights not expressly granted by
  115. Licensor are hereby reserved.
  116. 4. Restrictions.
  117. The license granted in Section 3 above is expressly made subject to
  118. and limited by the following restrictions:
  119. a. You may distribute, publicly display, publicly perform, or publicly
  120. digitally perform the Work only under the terms of this License, and
  121. You must include a copy of, or the Uniform Resource Identifier for,
  122. this License with every copy or phonorecord of the Work You
  123. distribute, publicly display, publicly perform, or publicly digitally
  124. perform. You may not offer or impose any terms on the Work that
  125. restrict the terms of this License or the ability of a recipient of
  126. the Work to exercise of the rights granted to that recipient under the
  127. terms of the License. You may not sublicense the Work. You must keep
  128. intact all notices that refer to this License and to the disclaimer of
  129. warranties. When You distribute, publicly display, publicly perform,
  130. or publicly digitally perform the Work, You may not impose any
  131. technological measures on the Work that restrict the ability of a
  132. recipient of the Work from You to exercise of the rights granted to
  133. that recipient under the terms of the License. This Section 4(a)
  134. applies to the Work as incorporated in a Collective Work, but this
  135. does not require the Collective Work apart from the Work itself to be
  136. made subject to the terms of this License. If You create a Collective
  137. Work, upon notice from any Licensor You must, to the extent
  138. practicable, remove from the Collective Work any credit as required by
  139. Section 4(c), as requested. If You create a Derivative Work, upon
  140. notice from any Licensor You must, to the extent practicable, remove
  141. from the Derivative Work any credit as required by Section 4(c), as
  142. requested.
  143. b. You may distribute, publicly display, publicly perform, or publicly
  144. digitally perform a Derivative Work only under: (i) the terms of this
  145. License; (ii) a later version of this License with the same License
  146. Elements as this License; (iii) either the Creative Commons (Unported)
  147. license or a Creative Commons jurisdiction license (either this or a
  148. later license version) that contains the same License Elements as this
  149. License (e.g. Attribution-ShareAlike 3.0 (Unported)); (iv) a Creative
  150. Commons Compatible License. If you license the Derivative Work under
  151. one of the licenses mentioned in (iv), you must comply with the terms
  152. of that license. If you license the Derivative Work under the terms of
  153. any of the licenses mentioned in (i), (ii) or (iii) (the "Applicable
  154. License"), you must comply with the terms of the Applicable License
  155. generally and with the following provisions: (I) You must include a
  156. copy of, or the Uniform Resource Identifier for, the Applicable
  157. License with every copy or phonorecord of each Derivative Work You
  158. distribute, publicly display, publicly perform, or publicly digitally
  159. perform; (II) You may not offer or impose any terms on the Derivative
  160. Works that restrict the terms of the Applicable License or the ability
  161. of a recipient of the Work to exercise the rights granted to that
  162. recipient under the terms of the Applicable License; (III) You must
  163. keep intact all notices that refer to the Applicable License and to
  164. the disclaimer of warranties; and, (IV) when You distribute, publicly
  165. display, publicly perform, or publicly digitally perform the Work, You
  166. may not impose any technological measures on the Derivative Work that
  167. restrict the ability of a recipient of the Derivative Work from You to
  168. exercise the rights granted to that recipient under the terms of the
  169. Applicable License. This Section 4(b) applies to the Derivative Work
  170. as incorporated in a Collective Work, but this does not require the
  171. Collective Work apart from the Derivative Work itself to be made
  172. subject to the terms of the Applicable License.
  173. c. If You distribute, publicly display, publicly perform, or publicly
  174. digitally perform the Work (as defined in Section 1 above) or any
  175. Derivative Works (as defined in Section 1 above) or Collective Works
  176. (as defined in Section 1 above), You must, unless a request has been
  177. made pursuant to Section 4(a), keep intact all copyright notices for
  178. the Work and provide, reasonable to the medium or means You are
  179. utilizing: (i) the name of the Original Author (or pseudonym, if
  180. applicable) if supplied, and/or (ii) if the Original Author and/or
  181. Licensor designate another party or parties (e.g. a sponsor institute,
  182. publishing entity, journal) for attribution ("Attribution Parties") in
  183. Licensor's copyright notice, terms of service or by other reasonable
  184. means, the name of such party or parties; the title of the Work if
  185. supplied; to the extent reasonably practicable, the Uniform Resource
  186. Identifier, if any, that Licensor specifies to be associated with the
  187. Work, unless such URI does not refer to the copyright notice or
  188. licensing information for the Work; and, consistent with Section 3(b)
  189. in the case of a Derivative Work, a credit identifying the use of the
  190. Work in the Derivative Work (e.g., "French translation of the Work by
  191. Original Author," or "Screenplay based on original Work by Original
  192. Author"). The credit required by this Section 4(c) may be implemented
  193. in any reasonable manner; provided, however, that in the case of a
  194. Derivative Work or Collective Work, at a minimum such credit will
  195. appear, if a credit for all contributing authors of the Derivative
  196. Work or Collective Work appears, then as part of these credits and in
  197. a manner at least as prominent as the credits for the other
  198. contributing authors. For the avoidance of doubt, You may only use the
  199. credit required by this Section for the purpose of attribution in the
  200. manner set out above and, by exercising Your rights under this
  201. License, You may not implicitly or explicitly assert or imply any
  202. connection with, sponsorship or endorsement by the Original Author,
  203. Licensor and/or Attribution Parties, as appropriate, of You or Your
  204. use of the Work, without the separate, express prior written
  205. permission of the Original Author, Licensor and/or Attribution
  206. Parties.
  207. 5. Representations, Warranties and Disclaimer.
  208. UNLESS OTHERWISE MUTUALLY AGREED TO BY THE PARTIES IN WRITING,
  209. LICENSOR OFFERS THE WORK AS-IS AND ONLY TO THE EXTENT OF ANY RIGHTS
  210. HELD IN THE LICENSED WORK BY THE LICENSOR. THE LICENSOR MAKES NO
  211. REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE WORK,
  212. EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT
  213. LIMITATION, WARRANTIES OF TITLE, MARKETABILITY, MERCHANTIBILITY,
  214. FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, OR THE ABSENCE OF
  215. LATENT OR OTHER DEFECTS, ACCURACY, OR THE PRESENCE OF ABSENCE OF
  216. ERRORS, WHETHER OR NOT DISCOVERABLE. SOME JURISDICTIONS DO NOT ALLOW
  217. THE EXCLUSION OF IMPLIED WARRANTIES, SO SUCH EXCLUSION MAY NOT APPLY
  218. TO YOU.
  219. 6. Limitation on Liability.
  220. EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, IN NO EVENT WILL
  221. LICENSOR BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY SPECIAL,
  222. INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT
  223. OF THIS LICENSE OR THE USE OF THE WORK, EVEN IF LICENSOR HAS BEEN
  224. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  225. 7. Termination.
  226. a. This License and the rights granted hereunder will terminate
  227. automatically upon any breach by You of the terms of this
  228. License. Individuals or entities who have received Derivative Works or
  229. Collective Works from You under this License, however, will not have
  230. their licenses terminated provided such individuals or entities remain
  231. in full compliance with those licenses. Sections 1, 2, 5, 6, 7, and 8
  232. will survive any termination of this License.
  233. b. Subject to the above terms and conditions, the license granted here
  234. is perpetual (for the duration of the applicable copyright in the
  235. Work). Notwithstanding the above, Licensor reserves the right to
  236. release the Work under different license terms or to stop distributing
  237. the Work at any time; provided, however that any such election will
  238. not serve to withdraw this License (or any other license that has
  239. been, or is required to be, granted under the terms of this License),
  240. and this License will continue in full force and effect unless
  241. terminated as stated above.
  242. 8. Miscellaneous.
  243. a. Each time You distribute or publicly digitally perform the Work (as
  244. defined in Section 1 above) or a Collective Work (as defined in
  245. Section 1 above), the Licensor offers to the recipient a license to
  246. the Work on the same terms and conditions as the license granted to
  247. You under this License.
  248. b. Each time You distribute or publicly digitally perform a Derivative
  249. Work, Licensor offers to the recipient a license to the original Work
  250. on the same terms and conditions as the license granted to You under
  251. this License.
  252. c. If any provision of this License is invalid or unenforceable under
  253. applicable law, it shall not affect the validity or enforceability of
  254. the remainder of the terms of this License, and without further action
  255. by the parties to this agreement, such provision shall be reformed to
  256. the minimum extent necessary to make such provision valid and
  257. enforceable.
  258. d. No term or provision of this License shall be deemed waived and no
  259. breach consented to unless such waiver or consent shall be in writing
  260. and signed by the party to be charged with such waiver or consent.
  261. e. This License constitutes the entire agreement between the parties
  262. with respect to the Work licensed here. There are no understandings,
  263. agreements or representations with respect to the Work not specified
  264. here. Licensor shall not be bound by any additional provisions that
  265. may appear in any communication from You. This License may not be
  266. modified without the mutual written agreement of the Licensor and You.
